  1. ABOUT THESE TERMS

Welcome to Divot Parade. These Terms of Service govern purchases from and use of our online store. “We,” “us,” and “our” refer to Divot Parade, a business based in Florida, United States.

By placing an order, you agree to these Terms and the applicable Shipping Policy, Refund Policy, and Privacy Policy published on this website. Nothing in these policies limits rights that cannot be excluded under applicable consumer protection laws.

  1. ORDERS AND CUSTOMER INFORMATION

You agree to provide accurate contact, payment, shipping, and personalization information when ordering. Please review your selected product, size, color, quantity, and delivery address before completing checkout.

You must be legally able to enter into a purchase agreement or have appropriate authorization from a parent or legal guardian.

We may decline or cancel an order for reasons such as suspected fraud, unavailable products, payment problems, or a material listing error. If we cancel an order after payment, we will refund the amount paid for the canceled portion, including applicable taxes and shipping charges.

  1. MADE-TO-ORDER PRODUCTS

Our products are generally made after an order is placed and fulfilled through third-party production partners. Items in the same order may be produced separately and arrive in different packages.

Product images may include digital mockups. Screen settings, materials, and production methods can cause reasonable differences in color, appearance, and placement. These variations do not excuse damaged, defective, incorrect, or materially misrepresented products.

  1. PRICES AND PAYMENTS

Prices are displayed in U.S. dollars unless otherwise indicated. Applicable taxes and shipping charges are shown at checkout.

Prices and promotions may change for future purchases. Changes do not alter the agreed price of an existing accepted order.

If we discover a material pricing or product-information error affecting your order, we will contact you to resolve it. We will not charge a higher price without your agreement.

  1. SHIPPING AND DELIVERY

Available destinations, shipping charges, and delivery estimates are provided at checkout or in our Shipping Policy. Production time is separate from transit time.

Delivery estimates are not guaranteed arrival dates unless expressly stated. If we cannot ship within the stated timeframe, we will notify you and provide any consent, cancellation, and refund options required by applicable law.

Please contact us promptly if a package is delayed, missing, damaged, or delivered incorrectly. An incorrect address supplied at checkout may result in additional charges for replacement or reshipment, where permitted by law.

  1. CANCELLATIONS AND ORDER CHANGES

To request a cancellation or change, email support@divotparade.com as soon as possible and include your order number.

If your order has not entered production, we can cancel it for a full refund or make an available change. Once production begins, changes or cancellation may no longer be possible. This does not affect cancellation or refund rights provided by law.

  1. RETURNS, DEFECTS, AND REFUNDS

Our Refund Policy explains eligibility and the process for requesting assistance.

Because products are made to order, we generally do not accept returns or exchanges for a change of mind or a customer-selected incorrect size or color, except where required by law.

If an item arrives damaged, defective, misprinted, or different from what you ordered, contact us within 30 days of delivery with your order number and clear photographs. We will provide a free replacement or a full refund for the affected item in accordance with our Refund Policy.

The reporting period above does not shorten any mandatory legal rights. Approved refunds are returned to the original payment method.

  1. PERSONALIZED ORDERS

For personalized products, review all submitted names, dates, spelling, and other details carefully. We may reproduce the information as submitted.

You must have permission to use any text or images you provide. You authorize us and our production partners to use that material only as needed to process, produce, deliver, and support your order.

If we reproduce your submitted information incorrectly, contact us so we can correct the problem.

  1. WEBSITE CONTENT AND ACCEPTABLE USE

Purchasing a product does not grant permission to reproduce our branding, artwork, photographs, or other website content for commercial purposes. Any use remains subject to applicable intellectual property rights.

You may not use this website for fraud, unlawful activity, infringement, malicious software distribution, or interference with the store’s operation.

  1. PRIVACY AND THIRD-PARTY SERVICES

Our Privacy Policy explains how personal information is collected, used, and shared.

Our store uses Shopify and third-party payment, production, and delivery services. Their involvement does not remove our responsibilities to you as the seller.

Links to external websites are provided for convenience. Those websites operate under their own terms and privacy practices.

  1. LIABILITY AND CONSUMER RIGHTS

To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of this website.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or removes your statutory rights concerning defective goods, refunds, or other consumer protections.

  1. CHANGES AND CONTACT

We may update these Terms for future use and purchases by publishing a revised version with an updated date. The terms applicable when you placed your order continue to govern that purchase, subject to applicable law.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, except where the law of your place of residence requires otherwise.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
